These Terms & Conditions apply to purchases made through the JAPAN-ITEMS™ online store and website, including all related pages, services, checkout functions, product pages and customer support channels.

The Store is operated by Japan Items Group sp. z o.o., with its registered address at ul. Wodzisławska 358, 44-274 Rybnik, Poland. Additional company details, including registration number, tax identification number and other legally required information, may be provided in the Legal Notice or company information section of the Store.

By using the Store, placing an order or purchasing a product, you agree to these Terms & Conditions. Please read them carefully before placing an order.

1. About JAPAN-ITEMS™

JAPAN-ITEMS™ is a curated international retail store offering selected objects sourced from Japan. The Store focuses primarily on pre-owned, vintage, collectible, discontinued, rare or otherwise previously owned items, including but not limited to audio equipment, cameras, musical instruments, watches, fashion accessories, books, media, collectibles and selected lifestyle objects.

JAPAN-ITEMS™ is not a marketplace. Customers purchase products from JAPAN-ITEMS™, not directly from third-party sellers in Japan. Third-party Japanese sellers, sourcing partners, logistics providers, carriers, payment providers and technology providers may be involved in the sourcing, handling, payment, fulfilment and shipment process, but the customer-facing seller is JAPAN-ITEMS™ unless expressly stated otherwise.

2. Store Model and Product Sourcing

Many products offered through the Store are unique or limited-availability objects sourced from Japan. Some products may be listed based on supplier information, marketplace availability, seller-provided information, photographs, product records or other available data.

After an order is placed, JAPAN-ITEMS™ may need to confirm whether the ordered item is still available, whether it can be sourced successfully, whether it can be shipped internationally and whether the item corresponds sufficiently to the information presented on the product page.

For this reason, placing an order does not always mean that the item is immediately secured or physically held by JAPAN-ITEMS™ at the time of purchase.

3. Product Availability and Order Acceptance

All products are subject to availability.

Because many items are sourced from third-party sellers in Japan and may be one-of-a-kind, discontinued, pre-owned or otherwise limited in quantity, an item may become unavailable after it has been listed on the Store or after an order has been placed.

An order is accepted only once JAPAN-ITEMS™ confirms that the ordered item can be sourced and fulfilled. If an item is unavailable, cannot be sourced, cannot be shipped, materially differs from the listing or cannot be fulfilled for another valid reason, JAPAN-ITEMS™ may cancel the order.

If an ordered item is no longer available, JAPAN-ITEMS™ will contact the customer as soon as reasonably possible. The customer may choose either:

  1. a full refund of the amount paid for the unavailable item; or
  2. where possible, an alternative comparable item proposed by JAPAN-ITEMS™.

No alternative product will be supplied without the customer’s express approval. If the customer does not accept an alternative item, the order will be cancelled and a full refund will be issued for the unavailable item.

4. Product Condition

Most items offered through JAPAN-ITEMS™ are pre-owned, vintage, collectible, discontinued or otherwise previously owned. They may show signs of age, prior use, patina, cosmetic wear, small scratches, marks, fading, ageing, replacement parts, missing original packaging, missing accessories or other characteristics typical of pre-owned and vintage goods.

Such characteristics are not considered defects if they were visible in the product images, described on the product page, reasonably expected due to the nature, age or category of the item, or otherwise typical for pre-owned, vintage or collectible goods.

Customers should carefully review all product images, product details and descriptions before placing an order. Product images form an important part of the item description.

Unless expressly stated otherwise, products should not be assumed to be new, unused, factory sealed, under manufacturer warranty or supplied with original packaging, manuals, certificates, accessories or documentation.

5. Product Descriptions and Images

JAPAN-ITEMS™ makes reasonable efforts to present products accurately based on available information, images and sourcing data. However, because many items are sourced from third-party sellers in Japan and may be unique, vintage or pre-owned, minor differences in appearance, packaging, accessories or presentation may occur.

Product colours may vary depending on screen settings, lighting, photography conditions and image processing. Measurements, specifications and compatibility information may be approximate unless expressly confirmed.

For vintage electronics, cameras, audio equipment, musical instruments and similar items, compatibility with modern systems, voltage requirements, regional standards, plugs, formats, consumables, batteries, tapes, discs, software, accessories or replacement parts may vary. The customer is responsible for checking compatibility before purchase unless JAPAN-ITEMS™ expressly confirms compatibility in writing.

6. Prices

Product prices are displayed in the currency selected or shown at checkout. Prices may include the product price, sourcing costs, handling, international shipping, applicable import charges, taxes, duties, customs charges and other service components, depending on the destination and checkout configuration.

Prices may change at any time before an order is placed. Once an order has been placed, the price paid by the customer will not be increased unless the customer requests a change to the order, shipping destination, delivery method or product selection.

If a pricing error is obvious, material or caused by a technical issue, JAPAN-ITEMS™ may cancel the order and refund the customer.

7. Duties, Taxes and Import Charges Included

JAPAN-ITEMS™ aims to provide an all-inclusive international shopping experience.

Unless clearly stated otherwise at checkout, the price paid by the customer includes standard international shipping, applicable import duties, import taxes, VAT, customs charges and standard carrier import processing charges related to the delivery of the ordered product.

JAPAN-ITEMS™ arranges or pays these charges through logistics partners, carriers, customs brokers, tax schemes or other applicable fulfilment arrangements.

The customer should not be required to pay standard import duties or import taxes separately upon delivery where the shipment is processed under JAPAN-ITEMS™ all-inclusive delivery arrangement.

If a customer is unexpectedly asked by a carrier, customs authority or delivery provider to pay import duties, taxes or standard customs charges upon delivery, the customer should contact JAPAN-ITEMS™ before making payment where reasonably possible. JAPAN-ITEMS™ will review the case and assist in resolving the issue.

Additional charges may apply only in exceptional cases, including but not limited to incorrect delivery information provided by the customer, refusal of delivery, failure to collect the parcel, storage fees, re-delivery fees, return shipment costs, address changes requested by the customer, special local administrative charges or charges not classified as standard import duties, taxes or customs charges.

8. Payment

Payment must be made using the payment methods available at checkout. The availability of payment methods may depend on the customer’s location, currency, risk checks, payment provider rules and Store configuration.

JAPAN-ITEMS™ may use third-party payment providers to process payments securely. JAPAN-ITEMS™ does not control all aspects of payment processing and may be required to comply with the rules, verification requirements, fraud prevention procedures and risk decisions of payment providers.

An order may be cancelled if payment is not successfully completed, if the payment provider declines the transaction, if fraud or misuse is suspected, or if verification requirements are not satisfied.

9. Shipping and Delivery

Products are sourced from Japan and shipped internationally to supported destinations.

Delivery times are estimates only and may vary depending on sourcing time, domestic handling in Japan, international shipping, customs processing, carrier performance, local delivery conditions, holidays, weather, force majeure events, security checks or other circumstances outside JAPAN-ITEMS™ reasonable control.

Tracking information will be provided when available.

JAPAN-ITEMS™ is not responsible for delays caused by customs authorities, carriers, incorrect delivery information, failed delivery attempts, customer unavailability, local import procedures, force majeure events or other events outside JAPAN-ITEMS™ reasonable control. This does not affect the customer’s mandatory legal rights.

Risk of loss or damage generally passes to the customer when the product is delivered to the customer or to a person designated by the customer, unless mandatory law provides otherwise.

10. Delivery Address and Customer Responsibility

The customer is responsible for providing complete, accurate and current delivery information.

If a parcel cannot be delivered because the customer provided incorrect or incomplete information, failed to collect the parcel, refused delivery or did not respond to carrier requests, JAPAN-ITEMS™ may charge the customer for additional reasonable costs caused by the issue, including re-delivery, return, storage or reshipment costs, where permitted by law.

If a parcel is returned to JAPAN-ITEMS™ or to a logistics partner due to customer-related delivery failure, JAPAN-ITEMS™ will contact the customer to determine whether reshipment is possible. Additional shipping or handling costs may apply.

11. Order Changes and Cancellations by the Customer

Customers should contact JAPAN-ITEMS™ as soon as possible if they need to change or cancel an order.

Because many items are sourced individually and internationally, order changes or cancellations may not be possible once sourcing, purchase, handling, packing, export processing or shipment has begun.

This does not affect the customer’s statutory right of withdrawal where applicable.

12. Returns and Right of Withdrawal

Customers may have a statutory right to withdraw from an online purchase within the period required by applicable consumer law. For customers in the European Union, this period is generally 14 days from the day on which the customer or a person designated by the customer receives the goods, unless a legal exception applies.

To exercise the right of withdrawal, the customer must inform JAPAN-ITEMS™ of the decision to withdraw from the contract within the applicable withdrawal period.

The customer may be required to return the product to the address provided by JAPAN-ITEMS™. The product should be returned without undue delay and in any event within the period required by applicable law.

Unless otherwise required by law or unless the item is defective, damaged or not as described, the customer may be responsible for the direct cost of returning the product.

Returned products must be complete and returned in a condition that does not go beyond what is necessary to inspect the nature, characteristics and functioning of the product. The customer may be responsible for any diminished value of the product resulting from handling beyond what is necessary to inspect it.

For pre-owned, vintage and collectible items, signs of age, prior use, patina, cosmetic wear or other characteristics visible in the images, described on the product page or reasonably expected due to the nature of the item are not considered defects.

13. Damaged, Incorrect or Non-Conforming Items

If a product arrives damaged, incorrect or materially different from the product page, the customer should contact JAPAN-ITEMS™ as soon as possible and provide clear photographs, order details, packaging photographs and any carrier documentation where relevant.

JAPAN-ITEMS™ will review the case and may offer a remedy required by applicable law, which may include repair, replacement, price reduction, refund or another appropriate solution.

For consumer complaints, JAPAN-ITEMS™ will respond within the period required by applicable law.

The customer should not return a product before receiving return instructions from JAPAN-ITEMS™, unless mandatory law provides otherwise.

14. Manufacturer Warranty and Product Support

Unless expressly stated on the product page, products sold by JAPAN-ITEMS™ are not supplied with a manufacturer warranty.

Vintage, discontinued, pre-owned or imported items may not be eligible for manufacturer support, regional service, software updates, spare parts, local warranty repair or compatibility assistance.

Nothing in these Terms limits any mandatory legal rights the customer may have against JAPAN-ITEMS™ as the seller.

15. Accounts

Customers may be able to create an account on the Store. Customers are responsible for maintaining the confidentiality of their account login details and for all activity under their account.

Customers should contact JAPAN-ITEMS™ immediately if they suspect unauthorized access to their account.

JAPAN-ITEMS™ may suspend or close an account where required for security, fraud prevention, legal compliance, misuse prevention or other legitimate reasons.

16. Acceptable Use

Customers must not use the Store for unlawful, fraudulent, abusive, misleading or harmful purposes.

Customers must not interfere with the operation of the Store, attempt unauthorized access, misuse checkout functions, scrape data without authorization, submit false information, infringe intellectual property rights, or use the Store in a way that may harm JAPAN-ITEMS™, other customers, service providers or third parties.

17. Intellectual Property

All content on the Store, including brand elements, text, layout, design, logos, photographs, product presentation, graphics and other materials, is owned by or licensed to JAPAN-ITEMS™ or its respective rights holders, unless otherwise stated.

Customers may use the Store only for personal shopping and informational purposes. No content may be copied, reproduced, distributed, modified, sold, commercially exploited or used without prior written permission, except where permitted by law.

18. Third-Party Services

The Store may rely on third-party services, including Shopify, payment providers, analytics providers, marketing tools, logistics partners, carriers, customs brokers and customer support tools.

Third-party services may have their own terms, policies and technical requirements. JAPAN-ITEMS™ is not responsible for third-party services beyond its legal obligations, but will use reasonable efforts to work with reputable providers.

19. Privacy

The collection and processing of personal information is described in the JAPAN-ITEMS™ Privacy Policy.

By using the Store, creating an account, placing an order or contacting JAPAN-ITEMS™, the customer acknowledges that personal information may be processed for purposes such as order handling, payment processing, shipping, customer support, fraud prevention, legal compliance, analytics and marketing, in accordance with the Privacy Policy and applicable law.

20. Limitation of Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law, including liability for intentional misconduct, fraud, gross negligence, death or personal injury caused by negligence, or mandatory consumer rights.

To the fullest extent permitted by applicable law, JAPAN-ITEMS™ is not liable for indirect, incidental, special, consequential or purely economic losses, including loss of profit, loss of business, loss of data or loss of opportunity.

JAPAN-ITEMS™ is not responsible for delays, failures or losses caused by events outside its reasonable control, including customs delays, carrier disruptions, natural disasters, strikes, war, civil unrest, cyber incidents, government action, regulatory changes, pandemics, import/export restrictions or force majeure events.

This section does not affect the customer’s statutory rights.

21. Force Majeure

JAPAN-ITEMS™ will not be responsible for failure or delay in performing its obligations where such failure or delay is caused by circumstances outside its reasonable control.

Such circumstances may include, without limitation, natural disasters, extreme weather, fire, flood, epidemic, pandemic, war, terrorism, civil unrest, labour disputes, customs delays, carrier disruptions, government restrictions, changes in law, cyberattacks, technical outages or failure of third-party services.

22. Compliance, Export and Import Restrictions

Some products may be subject to export controls, import restrictions, safety rules, customs requirements, carrier restrictions or local laws in the destination country.

JAPAN-ITEMS™ may refuse, cancel or refund an order if the product cannot legally or practically be shipped to the customer’s destination.

The customer is responsible for ensuring that the product can be lawfully used in the customer’s country, including any local compatibility, licensing, voltage, plug, radio, battery, media, safety or product-use requirements.

23. Changes to the Store and Terms

JAPAN-ITEMS™ may update the Store, product offering, prices, policies and these Terms from time to time.

The Terms applicable to an order are the Terms in force at the time the order is placed, unless a change is required by law or applies only to future use of the Store.

Material changes may be communicated where required by law.

24. Governing Law and Consumer Protection

These Terms are governed by the laws of Poland, unless mandatory consumer protection laws provide otherwise.

If the customer is a consumer residing in another country, the choice of Polish law does not deprive the customer of mandatory consumer protections that cannot be excluded under the law of the customer’s country of habitual residence, where applicable.

Customers may have the right to bring claims before courts or authorities as provided by applicable consumer protection law.

25. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will remain in effect.

The invalid, unlawful or unenforceable provision will be interpreted or replaced, to the extent permitted by law, in a way that most closely reflects its original purpose while remaining valid and enforceable.
